Zurich Airport News Flash No. 1 / Further milestone in the context of payments for formal expropriation

With the final judgement of December 9, 2011, the Swiss Federal Court has confirmed the methodology of how to calculate the indemnifications for reduced value of yield properties. Flughafen Zürich AG appreciates that based on this judgement the legal ground was laid in order to start the settlement of payments for formal expropriation, also for yield properties.

With the judgement on the methodology to calculate the indemnifications for reduced value of yield propertiers, further legal ground was laid in order to settle open claims. As the Swiss Federal Court has already decided about the liability of indeminification of yield properties in previous judgements, the judgement of December 9, 2011, was only about the decision of the adaptive calculation methodology. In view of the existing uncertainties, a last instance judgement of the Swiss Federal Court seemed to be essential. Based on the judgement of December 9, 2011, the compensation payments of further yield properties can now be carried out in a timely manner.

Flughafen Zürich AG still assumes the most likely total noise costs to be 740 million Swiss Francs. As communicated earlier, this amount includes costs for formal expropriations, costs for the sound insulation programme (« 2010 Programme ») as well as the costs for the construction of a new sound insulation hall.
